Understanding DMV Hours of Service Requirements
Every state's Department of Motor Vehicles (DMV) has specific rules about how long a commercial driver can work before taking a break. These are called Hours of Service (HOS) regulations. The Federal Motor Carrier Safety Administration (FMCSA) sets national standards, but individual states may have additional rules that drivers need to know about.

The main federal rule states that commercial drivers cannot drive more than 11 hours in a single day after being off duty for at least 10 consecutive hours. This means if a driver starts work at 6 a.m. after being off all night, they can drive until 5 p.m. (11 hours later) before they must stop. During a 14-hour workday, a driver can only spend 11 of those hours actually driving—the other 3 hours might involve paperwork, vehicle inspections, or loading cargo.
Weekly limits also exist. Drivers cannot work more than 60 hours in a 7-day period, or 70 hours in an 8-day period. Once a driver hits these limits, they must take a 34-hour break before driving again. For example, if a driver works 60 hours from Monday through Friday, they cannot drive on Saturday or Sunday until after they have been off duty for a full 34 hours.
Different types of driving have different rules. A person driving for a construction company to move equipment might follow different rules than someone driving a commercial truck across state lines. Property-carrying vehicles (trucks carrying goods) have stricter rules than passenger-carrying vehicles (buses). Some short-haul drivers who stay within 100 miles of their starting point may have slightly different regulations.
Practical takeaway: Review your state's DMV website to understand which specific HOS rules apply to the type of driving you do. Write down the daily and weekly limits so you can plan your work schedule accordingly.
How to Find Official DMV Hours of Service Resources
The most reliable source for HOS information is your state's DMV website. Every state maintains pages specifically about commercial driver regulations. These pages typically include downloadable documents, frequently asked questions, and links to state-specific rules that may differ from federal standards.

The Federal Motor Carrier Safety Administration maintains a central resource at fmcsa.dot.gov. This website contains the official federal HOS regulations, interactive maps showing state-by-state differences, and educational materials. You can search by your state to see which additional rules your state has added to federal requirements. The FMCSA site also provides information about the regulations that apply to specific vehicle types and cargo.
Many states offer free downloadable guides in PDF format that summarize HOS rules in plain language. These guides often include:
- Daily driving hour limits
- Weekly and bi-weekly work hour limits
- Required break lengths and timing
- How to calculate work hours correctly
- Exceptions for certain situations
- Penalties for violations
Some state DMV offices maintain physical copies of these guides at their local branches. If you prefer printed materials, you can visit your nearest DMV office and ask for the commercial driver HOS guide. Staff members can also answer specific questions about how the rules apply to your situation.
Professional trucking associations and safety organizations publish their own summaries of HOS rules. While these are not official government documents, they can help you understand complex rules in different ways. Organizations like the American Trucking Association and state trucking associations often maintain educational resources.
Practical takeaway: Bookmark your state's DMV website and the FMCSA website. Spend 15 minutes exploring these sites to locate the free HOS guides available in your state. Save or print documents you find, and share them with other drivers who may benefit from the information.
Planning Your Driving Schedule Within Legal Hours
Creating a work schedule that respects HOS regulations requires understanding the different types of time tracked. Driving time is when the vehicle is moving. On-duty time includes activities like loading cargo, conducting vehicle inspections, fueling up, or doing paperwork—this time counts toward your daily and weekly limits even though you are not driving. Off-duty time is when you are not working at all, and this time does not count toward limits.

A practical example: A driver starts work at 6 a.m. From 6 a.m. to 7 a.m., they inspect their truck and review their load (1 hour on-duty). From 7 a.m. to 5 p.m., they drive (10 hours driving). From 5 p.m. to 5:30 p.m., they refuel and document their cargo (30 minutes on-duty). Total for the day: 10.5 hours driving plus 1.5 hours on-duty equals 12 hours worked. This driver has 1.5 hours of driving time remaining before hitting the 11-hour daily limit, but they have used more than half their available on-duty time.
When planning a weekly schedule, track cumulative hours across multiple days. If you drive 55 hours Monday through Thursday, you only have 5 hours left to drive on Friday before hitting the 60-hour weekly limit. Depending on your cargo and route, you might need to take Friday partially off or wait until the following Monday to resume full driving.
Planning should account for required breaks. Federal rules require a 30-minute break after 8 hours of driving time. Some states require additional breaks or have different timing rules. If your state requires a break, this time is usually considered on-duty time, so it counts toward your daily and weekly limits, even though you are not driving during the break.
Many drivers use digital logs or paper logbooks to track their hours. Some systems send alerts when a driver is approaching their daily or weekly limits. By reviewing these logs weekly, you can spot patterns—for example, noticing that you consistently reach your limit on Thursday, which might signal you need to adjust your schedule.
Practical takeaway: Create a simple weekly tracking sheet showing your daily driving hours and on-duty hours for a typical week. Identify days when you come close to your limits. Adjust your planned schedule to build in buffer time so you never accidentally work over the legal limit.
Special Situations and Exceptions in Hours of Service Rules
Federal HOS rules include specific exceptions for certain types of driving and circumstances. Short-haul operations—where a driver stays within 100 air miles of their base and returns home daily—may have relaxed HOS requirements. A driver making local deliveries within 100 miles might face different daily limits than a driver crossing multiple states. However, if a short-haul driver occasionally makes a longer trip, that trip may require full HOS compliance.

Agricultural operations have unique exceptions. Drivers hauling agricultural products during harvest season may have different rules than drivers in other industries. Similarly, drivers transporting livestock or certain hazardous materials may face modified regulations. Your state DMV guide should clarify which exceptions apply to your type of work.
Weather emergencies and safety situations sometimes allow temporary exceptions. If a driver encounters dangerous weather or mechanical breakdown, they may be permitted to exceed normal hours to reach a safe location. However, this exception is not a blanket permission—it applies only in genuine emergencies. A driver cannot claim an emergency to cover poor planning.
Some states offer waivers or modifications for specific industries or situations. For example, certain public service vehicles or government-owned vehicles may follow different rules. Construction companies operating primarily within their state may have state-specific regulations that differ from interstate commerce rules.
The "34-hour restart" rule allows drivers to reset their weekly clock after 34 consecutive hours off duty. However, some states have modified this rule. Certain states require that the 34-hour break include two periods between midnight and 5 a.m., or they may not recognize the restart at all. Knowing whether your state allows the standard restart or has added restrictions is important for weekly planning.
Practical takeaway: If your driving operation involves anything unusual—agricultural products, short distances, livestock, hazardous materials, or government work—contact your state DMV or an official trucking association to learn whether special exceptions apply to you. Do not assume general rules cover your situation.
